District Lodge 171 wins Arbitration Award for IAM member

July 11, 2005 - James F. Bowen, an IAM member since 2001, has seen almost every aspect of his union contract tested in one way or another.  The latest test, Arbitration, was a difficult one but worth the wait.  Brother Bowen was wrongfully terminated February 6, 2004 from his position as a Heating/Cooling Operator for DynPar LLC located at Tinker AFB, OK.  The company terminated Brother Bowen for misuse of government computer and misuse of time.  In their investigation of the incident, the company failed to give the grievant any opportunity to present his side of the story.

DBR Jerry L. McCune and BR Tony L. Bennett, from DL 171 in Enid, Oklahoma, teamed up to arbitrate the case.  “This case was very complex with several issues discussed, but in the end justice prevailed.” DBR McCune said.  The arbitrator ruled in favor of Brother Bowen.  He reduced the termination to a 90 day suspension and awarded back pay and benefits for a total Award of $49,909.94.

James Bowen has always been a very active member in the IAM, becoming the Chief Steward, Grievance committeeman, Vice-President of Local Lodge 850 and has assisted in several organizing drives.  Even while he was terminated Brother Bowen stayed active in Local Lodge 850 affairs.

“This is a perfect example of what a strong union contract and commitment from the membership is worth.” Brother Bowen said.  “I am glad to get back to work and look forward to continued involvement in the IAM.”   

 General Vice President Bob Martinez said, “Congratulations to brother Bowen, and to the great job by brother MuCune and brother Bennett. This further shows how important a Union Contract is for justice on the job.”
