June 28, 2005 - Folsom, California: The International Association of Machinists (IAM) has prevailed against an Auto Nation dealership, again. Power Ford, of Torrance, Ca, has been directed by the National Labor Relations Board (NLRB) to post a notice of settlement in thirteen separate cases where the IAM filed charges against Power Ford for violating Federal Labor Laws. The violations occurred during the initial organizing drive where workers voted to join the IAM, as well as during the subsequent negotiations between the IAM and the Auto Nation dealership.
The NLRB ordered Power Ford to pay back wages to five employees hurt by the illegal actions of the Auto Nation dealership. Power Ford also has to remove any records of discipline taken against ten employees; the discipline was found to be retaliation for employee support of the IAM.
The settlement states that federal law protects workers rights to join a union. The posting lists of restrictions on Power Ford, stating that they:
· WILL NOT interfere with employees exercising their rights
· WILL NOT refuse to bargain collectively with the IAMAW
· WILL NOT refuse to provide the IAM with relevant and timely information
· Plus a dozen additional actions that Power Ford WILL NOT engage in
Another Auto Nation dealership, Desert Toyota in Las Vegas, was found guilty of twenty-five separate labor law violations. The NLRB ruled that the violations at Desert were so egregious that a fair election was impossible. Desert Toyota was ordered to recognize the IAM, and the Federal District Court of Nevada ordered the dealership to begin bargaining immediately.
