IAM District 9, Local 777 drivers at Unimark Truck Transport in Bridgeton, MO, have won a National Labor Relations Board (NLRB) suit against the company that could net over $1 million in back pay spread across up to 300 members.

An NLRB administrative law judge earlier this week ruled that Unimark violated its collective bargaining agreement with the IAM by dealing with employees as if they were independent contractors. The company’s “new business model,” implemented in 2012, required drivers to pay for their own insurance and fuel.
“This is a huge victory for the IAM,” said IAM Automotive Director Boysen Anderson, who provided testimony on behalf of Local 777 members. “The remedy may be another seven figures for unit employees.”
Unimark Truck Transport is a subsidiary of JHT Holdings, Inc., which also owns Auto Truck Transport. The IAM won an arbitration case against Auto Truck Transport in January on behalf of Locals 641 and 166 and District W24.
